A judgment is the court's decision in the case — and an enforceable instrument that can be enforced in the bailiff's court.
In practice
The judgment decides the case. But on its own it does not move a single krone: it gives you the right to proceed in the bailiff’s court and have an attachment levied.
A judgment also extends the life of the claim considerably. Where an ordinary claim becomes time-barred after three years, the limitation period is ten years once the claim has been established by judgment. That is one of the reasons why it can pay to obtain judgment on a claim even if the debtor has no money right now — and then to monitor.
Where it commonly goes wrong
- People stop at the judgment. The judgment is halfway. Without enforcement proceedings, nothing happens.
- People forget that the clock is reset. With a judgment, you have ten years. That makes monitoring a real strategy rather than a surrender.
